These Terms of Service ("Terms") govern your access to and use of https://trackxm.com (the "Site"), operated by Octissio ("Octissio," "we," "us," or "our") in connection with TrackXM, our enterprise experience management and survey platform.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

About the Site

The Site provides general information about TrackXM and a way to contact our sales team. The Site is not the TrackXM application itself. Access to and use of the TrackXM product is subject to a separate written agreement, order form, or subscription terms between you and Octissio.

Permitted use

You may use the Site only for lawful business purposes and in accordance with these Terms. You agree not to:

Use the Site in any way that violates applicable law or regulation;
Attempt to gain unauthorized access to the Site, its servers, or related systems;
Interfere with or disrupt the Site or its security features;
Scrape, crawl, or harvest data from the Site except as permitted by robots.txt or our prior written consent;
Misrepresent your identity or affiliation when contacting us;
Use the Site to transmit malware, spam, or other harmful content.

Contact submissions

When you submit the Contact Sales form, you represent that the information you provide is accurate and that you are authorized to share it. You agree that we may contact you about TrackXM and related Octissio services using the contact details you provide.

Submitting the form does not create a binding contract for the purchase of any product or service. Any commercial relationship is subject to separate agreement and acceptance by both parties.

Intellectual property

The Site and its content—including text, graphics, logos, trademarks, and design—are owned by Octissio or its licensors and are protected by intellectual property laws. Except for the limited right to access the Site for its intended purpose, no license or other rights are granted to you under these Terms.

TrackXM and related marks are trademarks of Octissio. You may not use our trademarks without prior written permission.

Third-party links and services

The Site may link to third-party websites or services, including Octissio's corporate site at https://octissio.com. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Disclaimers

The Site and all content on it are provided on an "as is" and "as available" basis for general informational purposes. To the fullest extent permitted by law, Octissio disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product descriptions, features, and roadmap information on the Site are subject to change. We do not guarantee that any particular feature will be available at any given time.

Limitation of liability

To the fullest extent permitted by applicable law, Octissio and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site.

Our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred Canadian dollars (CAD $100), except where liability cannot be excluded or limited under applicable law.

Indemnity

You agree to indemnify and hold harmless Octissio from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms, except to the extent caused by our negligence or willful misconduct.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for disputes arising from these Terms or the Site, except where mandatory consumer protection laws require otherwise.

Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were most recently revised. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
